Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the uWish Baby mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legal agreement between you and MountainCat sp. z o.o. ("Company", "we", "us"), a company registered in Poland.

2. Description of Service

uWish Baby is a baby sleep tracking application that allows parents and caregivers to:

  • Record and monitor baby sleep sessions (naps and nighttime sleep).
  • View sleep patterns, statistics, and insights.
  • Share baby data with invited caregivers for collaborative tracking.
  • Receive push notifications and reminders.

The App is provided as a tool for personal, non-commercial use. We reserve the right to modify, suspend, or discontinue any part of the service at any time.

3. Account Registration

To use certain features of the App, you must create an account by providing a valid email address and display name. You are responsible for:

  • Maintaining the confidentiality of your account credentials.
  • All activity that occurs under your account.
  • Providing accurate and up-to-date information.

You must be at least 16 years of age to create an account. By creating an account, you confirm that you meet this requirement.

4. User Responsibilities

You agree to use the App in compliance with all applicable laws and regulations. You shall not:

  • Use the App for any unlawful or unauthorized purpose.
  • Attempt to gain unauthorized access to other users' accounts or data.
  • Interfere with or disrupt the App's functionality or infrastructure.
  • Upload malicious content or attempt to exploit vulnerabilities.
  • Use automated systems or bots to access the App.

5. Intellectual Property

The App, including its design, code, graphics, logos, and content, is owned by MountainCat sp. z o.o. and is protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal purposes in accordance with these Terms.

You retain ownership of the data you enter into the App (baby profiles, sleep sessions, notes). We do not claim ownership of your content.

6. Caregiver Sharing and Data Access

The App allows you to invite other users ("Caregivers") to access your baby's data. By using this feature:

  • You acknowledge that invited Caregivers will be able to view and record sleep data for your baby.
  • You are responsible for managing who has access and can revoke access at any time.
  • We are not responsible for actions taken by Caregivers you have invited.
  • Caregivers must have their own accounts and agree to these Terms.

7. Limitation of Liability

Important Medical Disclaimer: uWish Baby is a sleep tracking tool only. The App does not provide medical advice, diagnosis, or treatment. Sleep data, patterns, and insights displayed in the App are for informational purposes only and should not be used as a substitute for professional medical advice.

Always consult a qualified healthcare provider with any questions about your baby's health or sleep. Never disregard professional medical advice or delay seeking it because of information provided by the App.

To the maximum extent permitted by applicable law:

  • The App is provided "as is" and "as available" without warranties of any kind.
  • We do not guarantee that the App will be uninterrupted, error-free, or secure.
  • We shall not be liable for any indirect, incidental, special, or consequential damages.
  • Our total liability shall not exceed the amount you have paid for the App in the twelve months preceding the claim.

8. Termination

You may terminate your account at any time by deleting it through the App's settings. Upon deletion, all your data β€” including baby profiles, sleep sessions, and caregiver connections β€” will be permanently removed from our servers.

We may suspend or terminate your account if:

  • You violate these Terms.
  • Your account has been inactive for an extended period.
  • We are required to do so by law.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Poland. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Poland.

If you are a consumer residing in the European Union, you also retain the protections granted by the consumer protection laws of your country of residence.

10. Changes to Terms

We may update these Terms from time to time. When we make material changes, we will notify you through the App or via email. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.

The "Last updated" date at the top of this page indicates when these Terms were last revised.
